Normally if your are riding your bike and abiding by the rules of the road the driver’s insurance company will be responsible for all of your damages including replacing or fixing your bike, medical bills, lost wages, pain and suffering and a permanent impairment.

Fault can be attributed to the driver even if the investigating police officer doesn’t indicate fault in her or his report. It seems this biker has a claim although a more detailed investigation would be in order:

SUMMARY OF CRASH:

On 1/1/2021 at approximately 1250 hours, the Vermont State Police received a report of a motor vehicle crash involving a bicycle on Main St in the Town of Fairfax. Investigation revealed the operator of the vehicle had been travelling South bound on Route 104/ Main St. and struck a bicyclist who was riding in the south bound travel lane of Main St. The bicyclist was travelling south bound on Main St making a left hand turn onto Brick Church Road prior to being struck.

The operator and bicyclist were transported to Northwest Medical Hospital in St. Albans for non-life threatening injuries. Neither speed nor impaired driving appear to be a factor.

The Vermont State Police was assisted on scene by the Fairfax Fire Department and Fairfax Rescue Squad.
